Many of the recovery problems emanating currently from the reinsurances placed by South American Reinsureds in the London market relate to misunderstandings as to cover given by the Reinsurers. This is particularly apparent in relation to the conditions imposed by Reinsurers under 'Claims Cooperation' and 'Claims Control' clauses. This article discusses the difficulties which these clauses and their interpretation have created, the legal context which surrounds them and the effect of the decision in the recent UK High Court case of 'Gan v.Tai Ping'.
